These general terms and conditions of sale (known as “GTC”) govern the relationships between sellers and buyers on the\u00a0<\/span>DavLite platform,<\/span><\/strong>\u00a0published by\u00a0<\/span>Saydav.<\/span><\/strong>\u00a0They apply to all orders placed on the site\u00a0<\/span>https:\/\/www.davlite.com<\/span><\/a><\/p>

1. Conclusion of the contract<\/span><\/strong><\/h3>

Any order for products implies unreserved acceptance of these general terms and conditions of sale, supplemented or amended by our specific conditions. These general terms and conditions cancel any contrary clause that may appear in the conditions of purchase, order forms or other commercial documents.<\/span><\/p>

2. Price<\/span><\/strong><\/h3>

Goods are invoiced at the rate in effect on the day the order is placed. Payment can be made using one of the payment methods available on the platform, upon home delivery (the parcel’s destination), upon collection of the parcel directly from the seller’s store, or at one of our\u00a0<\/span>checkpoints<\/span><\/strong>\u00a0\u00a0(agencies authorized for parcel collection).<\/span><\/p>

The general price list is attached to these conditions. Product prices are set by the sellers and may be revised subject to\u00a0<\/span>30 days<\/span><\/strong>\u00a0‘ prior notice .<\/span><\/p>

3. Delivery<\/span><\/strong><\/h3>

Delivery is carried out by<\/span><\/strong>\u00a0:<\/span><\/p>

\u2013 Direct delivery of the product to the purchaser.<\/span>
\u2013 Making the product available at a designated location.<\/span>
\u2013 Delivery to a shipper or carrier at the seller\u2019s premises or any other agreed location.<\/span><\/p>

Checking the goods<\/span><\/strong>\u00a0\u00a0:<\/span><\/p>

The buyer must check the goods upon receipt. In the event of damage, shortage, apparent defects, or non-conformity of the delivered product, the buyer must issue clear and precise reservations within\u00a0<\/span>5 days<\/span><\/strong>\u00a0\u00a0of the delivery date. These reservations must be notified in writing (via the return request form on the platform) to the seller or the sales team. The buyer must provide any justification as to the reality of the anomalies noted.<\/span><\/p>

4. Delivery times<\/span><\/strong><\/h3>

Delivery times are indicated based on supply availability.<\/span><\/p>

In the event of a delay in delivery lasting more than\u00a0<\/span>5 days<\/span><\/strong>\u00a0\u00a0after the indicative delivery date (except in cases of force majeure: war, riot, fire, strike, etc.), the buyer will have the option of canceling his order, without being able to claim any compensation whatsoever.<\/span><\/p>

5. Returns<\/span><\/strong><\/h3>

All product returns must be formally agreed upon between the seller and the buyer. Return conditions will be defined according to the seller’s policy and applicable legal provisions.<\/span><\/p>

6. Warranty<\/span><\/strong><\/h3>

The seller will take the greatest care in the execution of the order and in the quality of the products. In the event of a defect recognized by the seller, the latter’s obligation will be limited to the replacement or reimbursement of the defective quantities, without any other compensation.<\/span><\/p>

The following are excluded from the warranty:<\/span>
\u2013 Defects and damage resulting from storage, handling, transport or use in abnormal conditions.<\/span>
\u2013 Defects not in accordance with the nature, specifications or suitability for use of the product.<\/span><\/p>

7. Payment<\/span><\/strong><\/h3>

Payment by customers can be made<\/span><\/strong>\u00a0:<\/span><\/p>

\u2013 Via one of the payment methods available on the platform.<\/span>
\u2013 Upon delivery of the package.<\/span>
\u2013 Directly from the seller when collecting the package in store.<\/span>

Withdrawal request for sellers<\/span><\/strong>\u00a0\u00a0:<\/span><\/p>

To request payment, sellers must submit a withdrawal request directly from their supplier dashboard. It is imperative to specify a preferred withdrawal method in the payment settings via the dashboard.<\/span><\/p>

Withdrawal conditions<\/span><\/strong>\u00a0\u00a0:<\/span><\/p>

\u2013 All withdrawal requests must be greater than\u00a0<\/span>2,000 XOF<\/span><\/strong>\u00a0\u00a0(or the equivalent in the country’s currency).<\/span>
\u2013 Invoices are payable within\u00a0<\/span>24 to 72 hours<\/span><\/strong>\u00a0\u00a0depending on the chosen withdrawal method.<\/span>
\u2013 In the event of late payment, the seller may suspend all current orders.<\/span><\/p>

Platform fees<\/span><\/strong>\u00a0\u00a0:<\/span><\/p>

For the seller-customer connection, sponsorship and maintenance of the platform,\u00a0<\/span>10%<\/span><\/strong>\u00a0will be taken \u00a0from each item sold.<\/span><\/p>

No deposit or discount<\/span><\/strong>\u00a0\u00a0is accepted for early payment.<\/span><\/p>

8. Termination clause<\/span><\/strong><\/h3>

In the event of non-payment,\u00a0<\/span>72 hours<\/span><\/strong>\u00a0\u00a0after a formal notice has remained unsuccessful, the sale will be automatically terminated by the seller. The latter may request the return of the products in summary proceedings, without prejudice to any other damages. The remaining amounts due for other deliveries will become immediately payable if the seller does not opt \u200b\u200bto cancel the corresponding orders.<\/span><\/p>

9. Retention of title<\/span><\/strong><\/h3>

The goods sold remain the property of the seller until full payment of their price. However, the risks relating to the goods will be transferred to the buyer or the carrier upon physical delivery of the products.<\/span><\/p>

10. Attribution of jurisdiction<\/span><\/strong><\/h3>

These terms and conditions cancel and replace the previously applicable terms and conditions. Any dispute relating to these terms and conditions will be subject to the jurisdiction of the\u00a0<\/span>mixed commercial court<\/span><\/strong>\u00a0of the seller’s geolocation (according to the establishment of the seller’s commercial register) or of the country where\u00a0<\/span>Saydav<\/span><\/strong>\u00a0is established .<\/span><\/p>
